CreatorKrew ("CreatorKrew," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you use creatorkrew.com and our related services (the "Services"), whether you are a Brand, a Creator, a website visitor, or a job applicant.

This Policy is incorporated into our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.

01Scope and Roles

1.1 Who this covers. This Policy covers information we collect from Brands, Creators, agency representatives, prospects, and website visitors, whether via our website, our mobile experience, our APIs, email, or in the course of managing a campaign.

1.2 Our role. For most of the personal information we handle about Users, we act as a "business" or "controller." For information a Brand provides to us solely to run a Managed Services campaign (e.g., its own customer list, product data), we may act as a "service provider" or "processor," and the Brand's own privacy notice governs that data.

02Information We Collect

2.1 Information you provide directly

  • Account and identity data: Legal name, business name, email, phone number, mailing address, country, and time zone.
  • Payment and tax data: For Brands: billing address, payment card or ACH details (via our payment processor), tax ID where applicable, budget information. For Creators: payout details (bank account, wallet, or payment-processor identifiers), tax forms (W-9 for U.S. persons; W-8BEN for non-U.S. persons), and, where required, government-issued identification for identity verification.
  • Creator profile data: Portfolio links, sample content, social handles, follower counts (self-reported or via third-party APIs), audience demographics, niche and content categories.
  • Brand campaign data: Company name, industry, brand assets, product information, campaign objectives, target audiences, briefs, and approval feedback.
  • Communications: Messages, briefs, approvals, and support tickets exchanged through the Platform.

2.2 Information collected automatically

Usage and device data: IP address, device identifiers, browser type, operating system, referrer URLs, pages viewed, buttons clicked, session duration, and approximate location derived from IP. Cookies and similar technologies: First- and third-party cookies, pixels, SDKs, and similar technologies used for authentication, security, analytics, and, where consented, marketing. Performance analytics: For pay-per-view mechanics, we ingest view, engagement, and audience metrics from third-party platforms via their APIs subject to each platform's terms.

2.3 Information from third parties

Social platforms: Where you connect a social account or grant us OAuth access, we receive the data those platforms make available (e.g., account handle, follower count, video views, engagement). Payment processors: Stripe, Wise, or other processors send us transaction status, risk signals, and limited card metadata. Full payment card numbers are handled by the processor, not by us. Verification and compliance providers: Sanctions screening, KYC/KYB verification, and fraud-prevention vendors. Referrals: If your employer or a Brand you work with refers you or lists you as a contact.

03How We Use Personal Information

We use personal information to:

  • Provide, operate, and maintain the Platform, including authentication, matching Brands and Creators, publishing briefs, and processing submissions.
  • Process payments, disburse Creator payouts, and calculate management fees.
  • Handle tax reporting, including issuing IRS Form 1099-NEC or 1042-S where required, and cross-border withholding.
  • Verify identity, prevent fraud, deter bot views and engagement manipulation, and enforce our Terms.
  • Communicate about your account, campaigns, service updates, and, where permitted, marketing.
  • Improve, personalize, and develop new features (including AI-assisted matching and brief tools).
  • Comply with legal obligations, including sanctions screening, AML, and responses to lawful requests.
  • Establish, exercise, or defend legal claims.

04Legal Bases (GDPR / UK GDPR)

For individuals in the EEA, UK, or Switzerland, we rely on the following legal bases: performance of a contract with you (to provide the Services); legitimate interests (to secure the Platform, prevent fraud, improve the Services, and market to businesses), balanced against your rights; compliance with legal obligations (tax, sanctions, court orders); and consent (for marketing cookies, certain communications, and where required by law).

05How We Share Personal Information

  • Other Users of the Platform: As part of a marketplace, Creator profiles are visible to Brands, and Brand briefs and identity are visible to invited Creators. Do not include information in your profile you do not want visible.
  • Service providers: Payment processors (e.g., Stripe, Wise), cloud hosting (e.g., AWS or equivalent), analytics (e.g., Google Analytics), email delivery, customer support, KYC/AML providers, and other vendors bound by written data protection terms.
  • Brands (Managed Services): For Managed Services campaigns, aggregated or specified individual reports may be shared with the Brand as part of the campaign.
  • Corporate transactions: In connection with a merger, acquisition, financing, or sale of assets, subject to customary confidentiality protections.
  • Legal and safety: To comply with law, subpoena, court order, or lawful government request, or to protect the rights, property, or safety of CreatorKrew, our Users, or the public.
  • With your consent: With your consent, or at your direction (for example, to publish a case study).

We do not sell personal information for money. In the past twelve (12) months, we have not sold personal information as "sale" is defined under the California Consumer Privacy Act (CCPA/CPRA). We may "share" limited identifiers for cross-context behavioral advertising only if you have consented. You can opt out at any time (see Section 9).

06International Data Transfers

CreatorKrew is based in the United States, and Creators and Brands are located worldwide. Personal information may be transferred to, stored, or processed in the United States and other jurisdictions whose data-protection laws differ from those in your home country. Where required, we use appropriate safeguards, including the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum.

07Data Retention

We retain personal information for as long as your account is active and for as long as necessary to provide the Services, comply with legal obligations (including tax, accounting, and anti-fraud requirements), resolve disputes, and enforce our agreements. Typical retention periods:

  • Account and transaction records: up to seven (7) years for tax and accounting purposes.
  • Content and campaign records: up to five (5) years after the last campaign, then archived or deleted.
  • Marketing preferences: until you unsubscribe or object.
  • Support tickets and communications: up to three (3) years from resolution.

08Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS), encryption at rest for sensitive fields, access controls, logging, and vendor due diligence. No system is 100% secure. You are responsible for keeping your password confidential and for using a strong, unique password.

09Your Rights and Choices

9.1 All Users

Access and correct your account information from account settings. Close your account at any time (subject to retention obligations in Section 7). Manage email preferences via the unsubscribe link in marketing emails; transactional emails cannot be opted out of while your account is active.

9.2 California residents (CCPA / CPRA)

You have the right to: (a) know the categories and specific pieces of personal information we collect, use, disclose, or share; (b) request deletion; (c) request correction; (d) opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising; and (e) limit the use of sensitive personal information. We do not knowingly discriminate against you for exercising these rights. To submit a request, email [email protected] or use our web form at creatorkrew.com/privacy-request. We will verify your identity before acting on your request. You may use an authorized agent by providing written authorization.

9.3 EEA, UK, and Swiss residents (GDPR / UK GDPR)

You have the right to access, rectify, erase, restrict, port, or object to processing of your personal information, and to withdraw consent where processing is based on consent. You may lodge a complaint with your local data-protection authority.

9.4 Other jurisdictions

Residents of Colorado, Connecticut, Utah, Virginia, Texas, and other U.S. states with comprehensive privacy laws have similar access, correction, deletion, and opt-out rights, which we will honor consistent with those laws.

10Cookies and Tracking

We use strictly necessary cookies to operate the Platform (e.g., authentication and security), and, subject to your consent where required, analytics and marketing cookies to understand usage and measure campaigns. You can manage preferences via our cookie banner and, in most browsers, via browser settings. We honor Global Privacy Control (GPC) signals as an opt-out of "sale" and "sharing" under California law.

11Children's Privacy

The Services are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided information to us, please contact [email protected] and we will delete it.

12Third-Party Websites and Platforms

The Platform links to and interoperates with third-party sites and social platforms. Their privacy practices are governed by their own policies, and we are not responsible for them.

13Automated Decision-Making

We may use automated tools to detect fraud, bot traffic, and non-human engagement, and to help match Creators to briefs. These tools inform, but do not solely determine, decisions with significant effects on you. Where legally required, you may request human review of significant decisions by contacting [email protected].

14Changes to This Policy

We may update this Policy from time to time. Material changes will be notified by email or in-app notice at least seven (7) days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
